Terms of Use – Bodyess

These Terms of Use ("Terms") govern your access to and use of the Bodyess mobile application (the "Application"). The Application is developed by the Bodyess team ("Provider", "we", "our team").

By downloading, accessing, or using the Application, you agree to be bound by these Terms. If you do not agree, do not use the Application.

1. The Application

Bodyess is an artificial intelligence-based nutrition and healthy lifestyle application that helps users track food intake, analyze nutrition, monitor physical activity, and receive personalized recommendations.

The Application is intended for informational and educational purposes only. It does not constitute medical advice or diagnosis. Always consult a qualified medical professional before making changes to your diet or lifestyle.

Due to the possibility of weight loss during the use of the Application, users are advised to obtain medical consultation prior to its use in order to discuss personalized recommendations of the service. This particularly applies to individuals undergoing treatment or taking prescribed medications for clinically diagnosed conditions. The Provider recommends using the Application under medical supervision and undergoing regular medical examinations. The Provider does not assume responsibility for the actions of the user. The materials presented herein are not intended to supplement or replace information provided by a physician or pharmacist. By accepting these Terms, the user acknowledges that they bear full responsibility for their own health.

The Provider recommends that the user maintain body weight within the limits established by the World Health Organization (WHO) for a healthy weight, namely a body mass index (BMI) between 18.5 and 25. BMI is calculated as weight in kilograms divided by height in meters squared.

2. User Accounts

Certain features of the Application may require the creation of an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You may delete your account at any time in the Application settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

3. Subscriptions and Payments

Bodyess may offer paid subscriptions ("Subscriptions") that provide access to premium features and content.

Payment will be charged to your Apple ID or Google account upon confirmation of purchase.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

The renewal fee will be charged within 24 hours prior to the end of the current period.

You may manage or cancel your subscriptions in your account settings in the App Store or Google Play.

If a free trial is offered, any unused portion of the trial period will be forfeited upon purchase of a subscription.

In the event of the death of a User, their heirs shall have the right to cancel the subscription.

The Provider reserves the right to revise the cost of subscription plans. The new price shall apply only after the expiration of the current subscription period or at the time of the next renewal payment. In the event of a price increase, the Provider shall notify the User at least 30 calendar days prior to the effective date of such changes. If notice is provided less than 30 days in advance, the revised price shall apply only from the next billing period.

4. Acceptable Use

You agree not to:

Use the Application for unlawful purposes
Attempt to reverse engineer, copy, modify, or resell the Application
Misuse artificial intelligence features or attempt to exploit or manipulate model behavior
Upload malicious, offensive, or unlawful content
Circumvent, by any means, technical measures restricting access (including geographic restrictions) to gain access to paid features of the Application without proper authorization

We reserve the right to suspend or block accounts that violate these Terms.

5. Data Processing and AI-Based Recommendations

The Application uses artificial intelligence (AI) to analyze nutrition data, recognize food items, and generate recommendations.

AI-generated results are based on probabilistic models and may not always be accurate, complete, or suitable for specific circumstances. You acknowledge that you use AI-generated recommendations at your own risk.

6. Intellectual Property

All rights, title, and interest in and to the Application, including software, content, design, trademarks, and materials generated using artificial intelligence, belong to the Provider or its licensors.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Application solely for personal, non-commercial purposes.

7. Disclaimer of Warranties

The Application is provided "as is" and "as available". We make no warranties regarding uninterrupted access, accuracy of data, or achievement of specific health or fitness results.

8. Limitation of Liability

To the maximum extent permitted by law, the Provider shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Application.

9. Termination

We may suspend or terminate your access to the Application if you violate these Terms or applicable law.

We may delete your Application and account at any time.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Application after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
